RESUME DES FAITS ET DE LA PROCEDURE
1. Le 11 février 2024 LAMA a formé une demande reconventionnelle en nullité des brevets litigieux à la suite de
l’action en contrefaçon desdits brevets engagée contre elle le 13 octobre 2023 par HPDC devant la Division
Locale de Paris de la Juridiction unifiée du brevet (ci-après la « Division locale »).
2. Par décision au fond rendue le 13 novembre 2024, la Division locale a, notamment, prononcé la nullité du
brevet EP 2 089 230, rejeté la demande de nullité du brevet EP 1 737 669 et dit que LAMA était responsable
d’actes de contrefaçon du brevet EP 1 737 669 (ci-après la « Décision au fond »).
3. Le 13 janvier 2025, LAMA a interjeté appel de la Décision au fond (APL_1991/2025, UPC_CoA_24/2025),
demandant à Cour d’appel d’annuler le brevet EP 1 737 669 et de confirmer la décision du Tribunal de
première instance en ce qu’elle a annulé le brevet EP 2 089 230.
4. Le 3 juillet 2025, LAMA a demandé à retirer l’ensemble de ses demandes à l’encontre de HPDC et a accepté
le retrait des demandes de HPDC (App_32255/2025 UPC_CoA_23/2025).
5. Par décision du 24 juillet 2025, la Cour d’appel a accordé le retrait de l’ensemble des demandes formées par
HPDC et LAMA et déclaré la procédure clôturée.
6. Le 22 juillet 2025, les sociétés LIFE 365 ont déposé une demande d’intervention au soutien de la demande en
nullité engagée par LAMA à l’encontre des brevets litigieux.
7. Informées de la décision précitée rendue par la Cour d’appel le 24 juillet 2025, les sociétés LIFE 365 ont pris
acte de la clôture de la procédure d’appel et ont retiré leur demande d’intervention par acte régularisé sur le
CMS le 13 août 2025.
MOTIFS DE LA DECISION
8. Le retrait de la demande d’intervention est accordé pour les raisons suivantes.
