ORDONNANCE

FAITS et PROCEDURE

HEWLETT-PACKARD DEVELOPPEMNT COMPANY, L.P (dite « HP » ci-après) a initié à l’encontre de

LAMA FRANCE (dite « LAMA » ci-après) une action en contrefaçon devant la présente Division en

date du 11 octobre 2023 sur le fondement des brevets EP2089230 et EP1737669.

LAMA a soumis un mémoire en défense et une demande reconventionnelle en annulation des

brevets en cause.

HP a ensuite fait une demande en modification desdits brevets.

Il reste un dernier mémoire en réplique conformément à R. 32.3 RdP, attendu de la part de

LAMA pour le 16 août 2024.

C’est à ce stade de la procédure écrite devant la présente division que HP a soumis au juge-rap-

porteur une requête en communication d’informations datée du 15 juillet 2024 sur le fondement

de R.191 RdP, en demandant à la JUB d’ordonner à LAMA sous astreinte de 10 000 euros par jour

de retard à compter de la signification de l’ordonnance de communication d’informations :

- A titre principal, de communiquer l’identité de tout tiers ou partenaires de LAMA FRANCE ou de

ses filiales, intervenant dans la production et la distribution des produits litigieux (article 67.1.a)

et c) AJUB), les factures correspondantes, même caviardées, afin de confirmer l’identité des tiers

désignés ;

- A titre subsidiaire, si le droit français devait s’appliquer, de communiquer l’identité de tout tiers

ou partenaires de LAMA FRANCE ou de ses filiales, en dehors de France, intervenant dans la pro-

duction et la distribution des produits litigieux (article 67.1.a) et c) AJUB), les factures correspon-

dantes, même caviardées, afin de confirmer l’identité des tiers désignés ;

- A très subsidiaire, si le régime de responsabilité français devait s’appliquer pour des actes de

contrefaçon définis selon l’AJUB, de communiquer l’identité de tout tiers ou partenaires de

LAMA FRANCE ou de ses filiales, en dehors des pays Allemagne, Autriche, Belgique, Danemark,

France, Italie, Pays-Bas, Portugal et Suède, intervenant dans la production et la distribution des

produits litigieux (article 67.1.a) et c) AJUB), les factures correspondantes, même caviardées, afin

de confirmer l’identité des tiers désignés.

HP précise qu’elle consent à ce que les informations confidentielles des factures puissent être

caviardées ou qu’elle ne s’opposera pas à ce que des mesures de confidentialité selon la règle

262A du RdP soient adoptées.

Suite à une ordonnance préliminaire du juge rapporteur du 25 juillet 2024, LAMA a soumis ses

observations écrites en réponse le 31 juillet 2024 en s’opposant à la requête la disant inadmissible

car la contrefaçon n’a pas encore été établie à son encontre, tardive et non justifiée au vu des faits

du dossier. A titre subsidiaire, LAMA propose de limiter la communication d’informations à cer-

taines factures tel que qu’exposé en page 14 de ses observations écrites, sous confidentialité tel

que prévu par R.262 A RdP, et sans astreinte.
