Farmaceutica s.r.l. - A.C.E.F. s.r.l.

Related Cases
Netgear International Limited, NETGEAR Deutschland GmbH, Netgear Inc.vsRespondent
This order concerns an application by Netgear for shortening of time limits (acceleration of appeal proceedings) under Rules 225(e) and 9.3(b) of the Rules of Procedure. Netgear had appealed an order of the Local Chamber Munich that granted Huawei's request to extend its claim to include a second European patent (EP 3678321) in the main proceedings, which originally concerned only EP 3611989. The Court of Appeal rejected the application for acceleration, holding that filing on the last day of the applicable time limits did not justify shortening, given the respondent's interests and principles of due process, even though this could result in the statement of defense being filed in the first instance proceedings before the appeal is decided.
Hybridgenerator ApSvsInfotech Concept ApS, Infotech Holding ApS, HGSystem ApS, HGSystem Holding ApS, ***
This appeal concerned the composition of the Court when adjudicating on a request for the imposition of periodic penalty payments under R. 354.4 RoP. The Court of Appeal held that such a request must be adjudicated by a panel, not by a single judge. The appeal was brought by Hybridgenerator ApS against an order of the Copenhagen Local Division dated 3 March 2025, which had declined to impose penalty payments on the Respondents in proceedings concerning alleged infringement of European Patent EP 4 238 202.
Ona Patents SLvsGoogle Ireland Limited, Google Commerce Limited
Procedural order issued by the Düsseldorf Local Division of the Unified Patent Court concerning European Patent EP 2 263 098 B1. The court decided, with the consent of both parties, to hear the patent infringement action and the counterclaim for revocation jointly rather than bifurcating the proceedings. The decision was based on considerations of efficiency and the benefit of having validity and infringement decided together by the same panel for a uniform interpretation of the patent.
Samsung Electronics GmbH, Samsung Electronics Co. Ltd., Samsung Electronics France s.a.i.vsRespondent
Procedural order issued by the Local Division Munich concerning two related infringement actions (UPC_CFI_54/2024 and UPC_CFI_396/2024) involving European patent EP 2 391 947. Samsung, with Headwater's consent, requested an extension of the deadline to file comments on three pending applications, and the Presiding Judge granted the extension from 3 April 2025 to 8 April 2025, closing the four associated workflows.
Belparts Group N.V.vsIMI Hydronic International SA, IMI Hydronic Engineering AB
Procedural order issued by the Local Division Munich of the Court of First Instance scheduling proceedings in an infringement action concerning European patent no. 3 812 870. The panel decided not to bifurcate the proceedings and will hear both the infringement action and the counterclaim for revocation together, setting an interim videoconference for 24 March 2026 and an in-person oral hearing in Munich for 18 June 2026.
