Syngenta Limited v.Sumi Agro Limited & Sumi Agro Europe Limited
Syngenta Limited applied to the Local Division Munich for leave to amend its claim to extend the territorial scope of the infringement action to include Poland, the Czech Republic, and the United Kingdom, following the ECJ's decision in BSH Hausgeräte GmbH v. Electrolux AB (C-3999/22). Sumi Agro opposed, arguing the amendment could have been made earlier with reasonable diligence. The Court granted the application, holding that Syngenta could not reasonably have been expected to include the non-UPC territories in its original statement of claim, and adjusted the procedural timetable accordingly.

This case concerns an application by Sumi Agro to revoke provisional measures previously granted in favor of Syngenta Limited regarding European patent EP 2 152 073. The dispute centered on whether Syngenta had timely 'started proceedings on the merits' within the deadline set under Rule 213.1 RoP, given that the Statement of Claim was uploaded to the CMS on 27 September 2024 but the court fee was received on 30 September 2024. The Local Division Munich upheld the judge-rapporteur's dismissal of Sumi Agro's application, finding that Syngenta had started proceedings in due time, and granted leave to appeal.
Amgen Inc. v.Sanofi Winthrop Industrie S.A., Sanofi-Aventis Deutschland GmbH, Regeneron Pharmaceuticals Inc., Sanofi-Aventis Groupe S.A.
Amgen Inc. filed a patent infringement action against Sanofi and Regeneron entities before the Local Division Munich concerning European Patent 3 666 797 and their drug Praluent (Alirocumab). After the Central Division revoked the patent in its entirety on 16 July 2024, both parties agreed to stay the infringement proceedings pending the outcome of the appeal against the revocation decision.
