Glaxo Smith Kline Plc v.Controller Of Patents & Designs
The dispute concerned the application for Exclusive Marketing Right (EMR) under the Patents Act. After the relevant chapter was repealed by amendment in 2005, the appellants challenged the High Court's decision which had allowed appeals based on the argument that no further consideration of EMR was possible post-amendment.
